DEPARTMENT OF PRIVATE LAW
The Department of Private law is the oldest department at the Faculty - a chair in Roman-Dutch law was first introduced in 1919. The department has an outstanding record in research.
It has numerous NRF-rated researchers, many of whom are leaders in their respective research fields. Staff members are furthermore actively involved in individual and team research projects, contribute regularly to legal knowledge in the form of standard text books and publish widely in accredited journals. Research interests span the entire field of South African private law with special focus areas on the law of Obligations (contract, delict and unjustified enrichment), family law (especially children's rights), property law and land reform, the law of succession and trusts, comparative private law, legal history and customary law.
The department is responsible for teaching a number of compulsory modules on undergraduate level, eg Family Law, Law of Persons, Law of Succession, Property Law, Law of Contract and Delict and a number of elective modules in the final year of the LLB programme. On master's level the department also offers modules in comparative private law (especially obligations), sectional titles, law of trust and children's rights. Apart from excellence in teaching and research, members also serve on various Faculty and University committees, for example the University Disciplinary Committee. The department also has a proud history of being actively involved in the Stellenbosch Law Review.
